This privacy statement (together with any other documents referenced herein) explains how we collect, use, disclose, and secure information about individuals that constitutes personal data under applicable data protection and privacy laws (hereinafter, “Personal Data”) that is obtained via our website(s), our software applications, our communications (including email messages), and the services we provide to our customers (collectively, the “Services”). This statement also describes your choices and rights with respect to any Personal Data processed by Lakeside. By using the Services, you consent to the collection activities and data practices described in this privacy statement. If you do not agree to this privacy statement, please do not use the Services.
If you provide Personal Data of a third-party to Lakeside (e.g., when you sign up a colleague to receive information from or about Lakeside, when you provide information about a person to enable such person to have credentials or receive Services, or you analyze Personal Data of that person using Lakeside’s Services), you represent and warrant to Lakeside that you have all necessary authority to provide that information to Lakeside and to grant to Lakeside all rights in the information necessary for Lakeside to do everything with that information that this privacy statement permits Lakeside to do. Third-party services or applications that are used in connection with the Services may have their own privacy terms. Those terms should be read independent of this privacy statement.
We may update this statement from time to time and we encourage you to review this statement periodically. Lakeside will post any changes to this statement on its website. Your continued use of the Services and/or your continued provision of your information to Lakeside will be subject to the terms of the then-current privacy statement.
Legal Bases for Processing of Personal Data
Lakeside processes your Personal Data where (i) the processing is necessary to provide you (or your employer) our Services or otherwise perform a contract with you (or your employer), (ii) we have obtained your consent for an identified activity, (iii) it is necessary to comply with a legal or regulatory obligation, or (iv) for other legitimate interests (e.g., providing for the security and safety of the Services, to make/receive payments, to prevent and detect fraud, and/or to track your activities on our websites and/or software applications for purposes of personalization, optimization and advertising).
Collection of Personal Data by Lakeside
Personal Data That Lakeside Collects
Lakeside may automatically receive and store certain information (e.g., IP address and hostname) about you when you use our Services. Lakeside may also collect Personal Data such as name, email address, associated account name, information about your business role, information about the device you use to access our Services, and information about your service requirements. If you or your employer uses our software then we might also collect information such as device identifier, web browsing data, application performance metrics, application window focus, and file size information. As discussed in more detail below, we and our service providers may use a variety of technologies, including cookies, to assist in this activity. In addition, we use certain third parties to evaluate the use of our Services, to gather user feedback, and to improve the Lakeside customer experience. If you voluntarily provide us your email address when providing optional in-product feedback, we may combine your email address with usage data collected by such third parties.
If you sign up for one of our promotions, submit information to us via social media sites, participate in our surveys, apply for a job with Lakeside, or comment on any of our public message boards then we may also use that information. In addition, Lakeside may collect payment and billing information when you register for paid Services
How Lakeside Collects Personal Data
Lakeside collects some Personal Data from you when you provide it to Lakeside. This may occur through our website(s) or software applications, at conferences or marketing events, or typical business outreach initiatives. If you are an employee of our customer, we may also obtain data about you from your employer or via your employer’s use of our Services. We collect and process such data when:
If you interact with our sales team or contact our Help Desk, we may also collect your telephone number or other related contact information. Lakeside may also source some of your Personal Data which is publicly available on the internet or published by our third-party service providers.
When applying for a role with Lakeside you may be asked for specific Personal Data to determine your potential suitability for employment with us. This could include your physical location, contact information, resume details, educational background, prior work experience, professional certifications, and other information relevant to the role. In certain instances, we may ask you to voluntarily disclose sensitive Personal Data for legitimate recruitment-related purposes (e.g., to comply with anti-discrimination laws and/or for government reporting obligations).
When a customer purchases our software, we process Personal Data under such customer’s instructions and in accordance with the applicable customer’s contract with Lakeside. Our customer controls and is responsible for correcting, deleting, or updating the information it processes using the software and for complying with any regulations or laws that require notice, disclosure, or the obtaining of consent prior to transferring such Personal Data to Lakeside.

Data Transfers to Recipients Outside of the EEA/UK
Lakeside is a global company headquartered in the United States. To facilitate our global operations we may transfer your data to countries where our affiliated companies and third-party service providers are located, including the United States, Australia, India, Japan, Europe, and the United Kingdom. Lakeside has executed Standard Contractual Clauses with each of its affiliates and third-party service providers and has implemented other appropriate safeguards with them. Lakeside may contact you in your role as an employee of a potential customer to market our Services. You may opt-out of receiving such marketing outreach by following the instructions at the bottom of the applicable communication or at any time by e-mailing [email protected].
Data Retention
We retain your Personal Data for as long as needed: (i) to conduct business with you; (ii) fulfill the purposes outlined in this Privacy Statement; and (iii) to comply with our legal obligations, resolve disputes, and enforce any agreements. Criteria we will use to determine how long to retain your Personal Data include the nature and length of our relationship with you; our legal rights, obligations, and retention requirements; and if we have an ongoing business purpose for retaining your Personal Data, such as communicating with you about ongoing or prospective Services.
Protection of Personal Data
Lakeside maintains reasonable physical, technical, administrative, and organizational security measures intended to protect your Personal Data from accidental loss, alteration, unauthorized disclosure or unlawful destruction. These measures are commensurate with the sensitivity of the Personal Data we maintain about you. Unfortunately, the transmission of information via the internet is not completely secure. Despite these efforts to store Personal Information in a secure environment, we cannot guarantee the security of Personal Information during its transmission or its storage on our systems.
Information About Our Use of Cookies
When you visit our websites, sign up for a Lakeside account, attend a virtual event hosted by us, request more information about Lakeside, or otherwise use of our Services, then we may collect information automatically using tracking technologies like cookies or similar functionalities.
Lakeside and our partners use cookies or similar technologies to analyze trends, administer our websites, monitor visitor behavior, gather information about site traffic, and remember user preferences. You can set your browser to notify you when cookies are being set or to block certain cookies altogether. However, in a few cases, some of our website features may not function as a result of cookies being blocked by you. Please consult the “help” section of your browser for more information customizing your cookie settings.
Website Delivery and AI Chat Bot – We may use third-party providers to enable certain customer interaction opportunities. For example, we use a live chat feature powered by a third-party artificial intelligence service provider to enable customer service and support via our website. When you engage in the chat enabled by this service provider, we will automatically collect and share certain information (such as personal identifiers, usage information, and message content) with the vendor to provide the customer service and support enabled by the chat tool. When you engage in the chat, you are interacting with artificial intelligence, not a human representative.
Website Analytics and Session Replay – We use analytics and session replay services that use cookies and other technologies that collect your Personal Data, to assist us with analyzing our website traffic and site usage to optimize, maintain, and secure our website and inform subsequent business decisions (including, e.g., advertising). Interest-Based Advertising – We may also allow or enable third parties to collect Personal Data to provide their interest-based advertising on behalf of our products and services, or their own. Interest-based advertising occurs when advertisements are shown to you based on information collected from your online interactions over time and across multiple websites, devices, or online services that you visit or use. Some companies may engage in cross-context behavioral advertising to predict your preferences and show you advertisements that are most likely to be of interest or relevant to you.
We do not control these third parties’ collection or use of your information for these purposes, or the opt-out options they may individually offer you via their terms, conditions, and privacy policies. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly. Examples of the third-party service providers we engage to serve interest-based advertisements include Google Ads (including Google Dynamic Remarketing and Google Signals), LinkedIn marketing solutions (including LinkedIn Ads, Pixels, and Analytics), and Microsoft advertising. It is in this context that we may provide advertising networks, data analytics providers, social networks, and video sharing platforms with Personal Data such as your IP address, device information, Internet and other electronic network activity information, and geolocation information in the last twelve months.
Selling Personal Data – While we do not sell Personal Data in exchange for monetary consideration, we do disclose Personal Data for other benefits that could be deemed a “sale” under various data protection laws because it is sometimes broadly defined to include activities such as the delivery of interest-based advertising on websites or allowing third parties to receive certain information, such as cookies, IP address, and/or browsing behavior.

Information About Persons Under the Age of 18
It is Lakeside’s policy to refrain from knowingly collecting or maintaining Personal Data relating to any individual under the age of 18. If you are under the age of 18, please do not supply any Personal Data to Lakeside. If you are under the age of 18 and have already provided Personal Data to Lakeside, please have your parent or guardian contact Lakeside immediately using the information below so that Lakeside can remove such information from its files. If you are the parent or guardian of a person under the age of 18 and you have reason to believe that that person’s Personal Data has been collected by Lakeside, please contact Lakeside immediately.

Depending on where you live, you may have certain rights with respect to any of your Personal Data provided to Lakeside. Depending on the applicable laws these rights may include the following:

You may also exercise your opt out rights by broadcasting an Opt-Out Preference Signal, such as the Global Privacy Control (GPC). We honor Opt-Out Preference Signals, including GPC. If you choose to use an Opt-Out Preference Signal, you will need to turn it on for each supported browser or browser extension you have.
Lakeside will evaluate all requests and provide our response within the time period mandated by applicable law. If we require more time, we will inform you of the reason and extension period in writing. Please note, however, that you may be directed by Lakeside to make a separate request of your employer in the event that your employer is a customer of Lakeside using our Services to process your Personal Data.
Only you, or an authorized agent that you authorize to act on your behalf, may make a request related to your Personal Data. Lakeside may also require that you provide us with confirming information to verify your identity before we respond to your request. If we cannot verify your identity, we may request additional information from you. If you are an authorized agent making certain requests on behalf of another person, we will also need to verify your identity, which may require proof of your written authorization or evidence of power of attorney.
You will not be discriminated against in any way by virtue of your exercise of the rights listed in this privacy statement. However, should you withdraw your consent or object to processing of your Personal Data, or if you choose not to provide certain Personal Data, we may be unable to provide some, or all, of our Services to you.
We do not charge a fee to process or respond to your request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request. Additionally, you should be aware that certain Personal Data may be exempt from such requests (e.g., where Lakeside is required to keep such information to comply with a legal obligation). If you are not satisfied with the resolution of your request and you are afforded a right to appeal such decision, you will be notified of our appeal process in our response to your request.
Data Privacy Framework
Lakeside complies with the EU-U.S. Data Privacy Framework (“EU-U.S. DPF”), the U.K. Extension of the EU-U.S. DPF and the Swiss-U.S. Data Privacy Framework (“Swiss-U.S. DPF”) as set forth by the U.S. Department of Commerce. Lakeside has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles with respect to the processing of personal data received from the European Union under the EU-U.S. DPF and from the United Kingdom (including Gibraltar) under the UK Extension to the EU-U.S. DPF. In addition, Lakeside has certified its commitment to the Swiss-U.S. DPF Principles with respect to the processing of personal data received from Switzerland under the Swiss-U.S. DPF. If there is any conflict between the terms in this privacy statement and the EU-U.S. DPF Principles and/or the Swiss-U.S. DPF Principles, in each instance the applicable DPF Principles shall govern. Lakeside adheres to the DPF Principles for onward transfers of personal data to third parties and remains liable for damages caused by third parties under the DPF unless Lakeside did not cause the event giving rise to damage. The Federal Trade Commission has jurisdiction over Lakeside’s compliance with the EU-U.S. DPF, the U.K. Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF. In certain situations, Lakeside may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.
